Terms of Service

Please read through the ToS carefully, you agree to these terms upon providing payment for a commission.

General:

• No claiming products as your own, removal of watermarks or redistribution of them.
• No refunds for digital goods sold on Gumroad, Jinxxy, or the Second Life Marketplace. Support available! Reach out to me through Discord.
• Purchases only valid on Gumroad, or Jinxxy. (VRChat Specific).
• Proper credit with a hyperlink to my Gumroad/Jinxxy is required when using products purchased and used within VRChat on other assets.
• Purchases only valid from my stores on Gumroad, or Jinxxy.com (VRChat Specific).

Cancellation/Refund Policy:

I have the right to cancel or decline a commission at my discretion should unexpected circumstances arise that require me to do so. If I choose to cancel a commission, you will be issued a full refund. However, should any disrespectful, rude, or any unwanted behavior towards me occur that pushes boundaries or puts me outside of my comfort zone, I reserve the right to retain payment for any work already completed. In such cases, you will receive the work done so far, allowing for another artist to continue from where I left off.Rude and disrespectful behavior generally means outright rude or mean-spirited insults to my work that do not provide actual critical feedback or comments so I can adjust my work to your satisfaction (but is not limited to this), I maintain a professional and respectful sense of decorum with all of my clients and I expect my clients to maintain the same sense of respect and professional communication. Therefore I maintain the right to cancel the commission if mutual respect is not upheld.Should you decide to cancel a commission after it has passed the initial design and concept phase and work has already begun on retopology/optimization, texturing, or rigging I retain the right to keep any paid installments made up to that point. If you are cancelling due to an emergency/life event and expect to resume sometime in the future please make me aware, otherwise any work performed will be kept on my storage devices for a period of 1 month before being removed.I consistently seek your critical feedback through each stage of the process through visual and video/gif progress updates to ensure your satisfaction. Since it is your responsibility to provide timely feedback for necessary adjustments, refunds will not be issued for dissatisfaction with the final model upon project completion.

Intellectual Property Rights:

• I will not redistribute an asset you have commissioned provided you have paid in full for said asset without your permission.
• Assets purchased or commissioned from me do not automatically give you ownership rights to redistribution of said asset. (Ex. Make it part of another model/asset/merchandise, making the asset publicly available, selling the asset.) I request that you contact me beforehand upon intention to redistribute or market as part of another product or merchandise.
• I reserve the right to use commissioned work for portfolio and promotional purposes.

Payment Information:

• I primarily take payment through Paypal, however I can also accept through Venmo.
• Payment plans are do-able, normally all commissions are subject to 50% payment up-front. However I will accept up to FOUR payment installments of up to 25% minimum of the total cost of an asset made over the course of a few weeks to two months maximum. With final assets delivered upon receiving complete payment.
• You will be reserved a slot upon agreement to have commission work done by me and I will take the initial payment from you when I begin working on your commission.

Revisions:

• You are entitled to revisions or fixes of any errors made on my behalf.
• If a part of an asset requires a revision that was not clearly outlined or expressed upon the initial agreement and payment of work is needed, you will be charged an appropriate fee in accordance with the amount of time/effort and skill/resources required to make said changes. Please note that I will require and document any final agreement made between us for my own records as a means to prevent scamming.
• Your work will be kept within my storage devices for a maximum period of 1 month before I reserve the right to discard any old files. Please ensure you save any work/references I send you in order to prevent total loss for your own safekeeping.
